Confirmed Serial Adulterer Passes Alleged Serial Harasser in GOP Race

Here in a nutshell is the state of play in the 2012 Republican presidential sweepstakes: alleged serial sexual harasser Herman Cain is being surpassed by confirmed serial adulterer Newt Gingrich . With Mitt Romney stalled and Cain hemorrhaging support from women voters, polls last week from CBS and Marist showed the former House Speaker had surged into a virtual three-way tie at the top. By Monday, new surveys from CNN and PPP showed Newt vaulting past the fading pizza maker. Nevertheless, that development should be a discomforting prospect for a Republican Party which lost the women's vote by 13 points in 2008. As his public statements and personal life show, the thrice-married Gingrich is hardly a champion for American women.
That starts with Newt Gingrich's belief that marriage is an institution between one man and three women in rapid succession.
In 1980, Newt was separated from his first wife and former high school geometry teacher , Jackie Battley. As she lay incoherent in her hospital bed following surgery for a reoccurrence of uterine cancer, Gingrich paid her a visit to announce he wanted a divorce. As Lee Howell , a Gingrich friend and associate at whose wedding Newt was best man, described it: >
"Newt came up there with his yellow legal pad, and he had a list of things on how the divorce was going to be handled. He wanted her to sign it. She was still recovering from surgery, still sort of out of it, and he comes in with a yellow sheet of paper, handwritten, and wants her to sign it. >
Newt can handle political problems, but when it comes to personal problems, he's a disaster. He handled the divorce like he did any other political decision: You've got to be tough in this business, you've got to be hard. Once you make the decision you've got to act on it. Cut your losses and move on."
He moved on to wife number two, Marianne Ginther . But Marianne fared little better, getting dumped for Congressional staffer Callista Bisek after a six year affair even as Newt was leading the inquisition of Bill Clinton. As Vanity Fair summed it up last year: >
According to Salon, Gingrich and the former Hill staffer (23 years his junior, mind you) would frequently dine in the Supreme Court cafeteria--an unsuspectingly sordid detail. (In 1995, Vanity Fair referred to Bisek as Gingrich's "frequent breakfast companion.") Gingrich stepped down from Congress in 1998 following an ethics scandal, among other things. The two were married two years later.
Gingrich, who swapped his Baptist faith for Catholicism just in time to attack President Obama's 2009 address at Notre Dame University, later explained that his rapid fire infidelities were the actually product of his own patriotism: >
"There's no question at times of my life, partially driven by how passionately I felt about this country, that I worked far too hard and things happened in my life that were not appropriate. And what I can tell you is that when I did things that were wrong, I wasn't trapped in situation ethics, I was doing things that were wrong, and yet, I was doing them."
Of course, the things Newt Gingrich was saying to American women weren't any better.
As the New York Times recounted 16 years ago, Newt suggested menstruation should keep women out of essential roles in the American military: >
"If combat means living in a ditch, females have biological problems staying in a ditch for 30 days because they get infections, and they don't have upper-body strength. I mean, some do, but they're relatively rare. On the other hand, men are basically little piglets -- you drop them in the ditch, they roll around in it, doesn't matter, you know."
And for Gingrich, the biggest "infection" of them all - liberalism - caused a young mother to murder her children.
Back in 1994, after dumping his cancer-stricken first wife but before marrying his mistress following the adulterous affair that ended his second marriage, Newt pointed the finger at Democrats for the Susan Smith affair.
It was Smith who drew Americans' initial sympathy - and subsequent scorn - for her invention of a black bogeyman to conceal her heinous crime.
On October 24th, 1994, as the New York Times recalled, Smith killed her young sons, killings for which she was eventually sentenced to life in prison: >
That night, investigators say, Mrs. Smith pulled her car to the edge of a deep lake, stepped out, put the gearshift in drive and let it roll down the boat ramp into the black water. Her two little boys, buckled snugly in their safety seats, died under the lake... >
..."I believed her, right up to the end," said Juliaette Kerhulas, of Mrs. Smith's story that a young black man had ordered her out of her burgundy 1990 Mazda on the night of Oct. 25, then driven away with 3-year-old Michael and 14-month-old Alexander in the back seat.
Ms. Kerhulas wasn't the only one who believed in her. None other than future House Speaker Newt Gingrich rushed to the defense of Smith, whose step-father ironically happened to be a prominent Republican fundraiser and member of the Christian Coalition. Even after her confession, Gingrich insisted the Smith murders showed the decay of American society under Democratic Party rule : >
Enter Newt Gingrich, who rushed into action on election eve with another reliable generic culprit: society. He said the double murder "vividly reminds every American how sick the society is getting and how much we need to change things," expediently adding that "the only way you get change is to vote Republican."
As Frank Rich recounted in August 1995: >
Asked later by Tom Brokaw to elaborate, the Speaker-to-be cited "a direct nexus between the general acceptance of violence" and "the pattern that the counterculture and Lyndon Johnson's Great Society began in the late 60's."
Of course, the 1960's also happened to be the time when the women's movement rose to prominence. The victories it achieved for women's political equality, economic independence and reproductive rights transformed American society and helped move the nation closer to a "more perfect union."
Apparently, those epochal changes escaped Herman Cain's notice. And while Cain's is being punished in the polls for it, he is being replaced atop the GOP field by Newt Gingrich . While that may be a good thing for Tiffany's bottom line , it's a sad development for American women.

The emotions of a tennis match resemble those of a fight. Players may realize that winning a match doesn't really matter, but they will always want to win anyway.
CHAPTER 2: THE EMOTIONAL ISSUES OF COMPETITION: Tennis is inherently an emotional game. Because match outcomes feel important but are ultimately uncontrollable, matches can become stressful. There is often an unconscious urge to escape this stress, which leads to counterproductive behaviors, among which are anger, tanking, and excuse-making. These can be overpowered by the conscious mind, but it requires understanding, high motivation, and constant effort.
CHAPTER 3: USING EMOTION TO HELP YOU WIN: Your emotions will dramatically affect your tennis performance. We discuss how to keep counterproductive emotions in check and how to create productive ones that will help you win. Topics include the use of adrenalin, profiting from the time between points, and maintaining an optimal excitation level.
CHAPTER 4: REDUCING THE STRESS: Matches can become overly stressful, and this hinders performance. Stress can be reduced by developing a more realistic perspective of the game. Included are accepting outcomes that can't be controlled; resisting a narrow focus on winning; avoiding excessive perfectionism; getting over losses quickly; and using goals for hope and motivation rather than allowing them to become expectations and cause stress.
CHAPTER 5: THE PROBLEMS OF FINISHING: Most players become nervous and stressed when they are ahead and face the hurdle of finishing the match against a dangerous opponent. The unique tennis scoring system intensifies this problem. The closer players get to winning, the greater the stress. Trying to reduce it gives rise to counterproductive behaviors such as procrastinating the finish or becoming "overconfident" and easing up with a lead.
CHAPTER 6: CHOKING - ITS CAUSES AND HOW TO MINIMIZE ITS EFFECTS: Choking is most frequent at the finish of games, sets, and matches due to the uncertainty of outcome. You can limit choking damage by immediate acceptance of this uncertainty. Avoid stressful thoughts of winning by using rituals, focusing, and relaxation techniques. Rid yourself of the idea that choking will make you lose, and recognize that there are usually multiple opportunities to win, not just one.
CHAPTER 7: CONFIDENCE AND HOW TO GET IT IF YOU DON'T HAVE IT: Confidence, aka self-belief, comes mostly from winning. Though it's more difficult, you can win without it by replacing it with sufficient emotional discipline. Slumps and hot streaks occur in cycles and both end naturally with time. Stressing over a slump prolongs it. You can speed its ending by several methods which we discuss.
CHAPTER 8: GAME PLANS: Game plans give your efforts direction and structure. They can rely primarily on offence or defense but should be consistent with your personality. With Plan A you are looking for a match-up where you have a relative advantage, most commonly pitting your strengths against your opponent's weaknesses. With Plan B, which you always employ simultaneously with Plan A, you attempt to tire your opponent mentally.
CHAPTER 9: BREAKING DOWN YOUR OPPONENT MENTALLY: You can weaken your opponent mentally by using dominance techniques. Be aware of momentum development - maintain it when you're winning and break it when you aren't. Take advantage of the let-downs that occur in transitional situations: at the end of sets, after long points, after service breaks, and after long games. Learn to resist becoming psyched out by opponents.
CHAPTER 10: MAINTAINING MENTAL EFFECTIVENESS IN THE HEAT OF BATTLE: Remember the Golden Rule of tennis: Never do anything on court that doesn't help you win. Decide beforehand how you will handle the frustrations and errors that are likely to occur during match play. Understand the value of intensity and its role in playing percentage tennis. Players who have beaten you too frequently get into your head. Beating them requires exceptional emotional discipline and focus. Learn to deal with injuries, both yours and those of your opponents.
CHAPTER 11: THE VALUE OF OPTIMISM: Being optimistic is always helpful during competition. If it does not occur naturally you can become more optimistic by deliberately focusing on the real positives that exist in every situation. Monitor your thoughts and be alert to negative ones. When one occurs replace it immediately with a positive one. A bad attitude is difficult to change in mid-match, so make sure to start out with a good one. When you are behind, hope is your most crucial asset, and it is always realistic.
CHAPTER 12: DEVELOPING YOUR GAME AND THE ROLE OF PARENTS: Tennis is a difficult game and not enjoyable until you can control the ball with some level of consistency. The "middle game" is the heart of any player's game, and is learned by intelligent, repetitious practice, Tennis should generally be made fun for beginning youngsters, but some little push may occasionally be necessary. Tournaments can be motivating for kids, but they are stressful for parents and can impel even a good parent to act improperly.
CHAPTER 13: COURAGE AND HIGHER VALUES: Competing successfully in tennis is helped by focusing on character development rather than on winning. Everybody wants to win anyway. Working to develop higher values such as courage, unselfishness, consideration for others, appreciation, and morality is good for your character and will, as a by-product, reduce your stress and help you win.
CHAPTER 14: THE PSYCHOLOGY OF DOUBLES: An important doubles skill is the ability to make your partner play better. You affect your partner's emotional state and level of play with your gestures and words. The emotions of a tennis match resemble those of a fight. Players may realize that winning a match doesn't really matter, but they will always want to win anyway.
CHAPTER 2: THE EMOTIONAL ISSUES OF COMPETITION: Tennis is inherently an emotional game. Because match outcomes feel important but are ultimately uncontrollable, matches can become stressful. There is often an unconscious urge to escape this stress, which leads to counterproductive behaviors, among which are anger, tanking, and excuse-making. These can be overpowered by the conscious mind, but it requires understanding, high motivation, and constant effort.

Fact Check: Cravaack Makes Several False Statements In Debate With Oberstar

The research for these fact checks was prepared by students and graduates of the Masters of Advocacy and Political Leadership program at the University of Minnesota Duluth. First fact check a statement from Chip Cravaack about 9/11. > Cravaack : “In regard to Afghanistan, you have to remember that the bi-partisan 9/11 Commission stated we are at war with Islamic fundamentalists. And right now that war is in Afghanistan.” False. The phrase “at war with Islamic fundamentalists” never appears in the official published 9/11 Commission Report. > Oberstar: “That meltdown of the economy was devastating. It (The Recession) started in December 2007. The recession accelerated with great pace throughout 2008…” This is true . According to the National Bureau of Economic Research started in December of 2007. Next: Federal health care reform. > Cravaack: “And what did we get in return? What we’ve done… received is increased costs in our businesses, and a loss of jobs. This can be demonstrated right by, right down by, Medtronic. Medtronic has directly attributed this health care bill to $200 million loss… “ Cravaack’s statement that Medtronic would face a $200 Million dollar loss is misleading. While Medtronic faces an excise tax beginning in 2013, Medtronic says it may have additional income because of the health care law and cannot predict an actual gain or loss. > Craavaack “…and they said they could possibly lose up to 1,000 employees.” Cravaack’s statement that Medtronic says it could lose up to one thousand jobs is false. In some cases the policies may be replaced by more generous coverage with the government subsidizing the premiums. > Oberstar “And the plan will save over $750 billion over ten years, according to the government’s Congressional Budget Office, and will save a trillion dollars over 20 years.” Oberstar’s claim of a trillion dollar savings over 20 years is misleading . There will be long-term savings, but the Congressional Budget Office says it does not provide estimates beyond a 10-year period. Next: claims about Oberstar’s clean water restoration act > Moderator: “Please discuss with us your opinion of how the proposed Clean Water Act will affect us in the 8th district. “ > Cravaack “The Clean Water Act, Congressman Oberstar has a current bill out that’s called The America’s Commitment to Clean Water Act. What it’s going to do is actually federalize all waters of the United States…” Cravaack’s use of the term “federalize” is unclear and could be misleading . Allowing for federal regulation does not mean the federal government would confiscate wetlands. > Cravaack: “…up to and including a seasonal slough or even including a wet meadow. This will put a layer of restrictions and regulations coming from the federal government. The In-Office Interview at the Law Office We advise potential clients to bring in a copy of the complaint, all their papers in connection with their case, accident report, and any documents they received from the Motor Vehicle Commissions. Often times I will instruct them to write a confidential narrative if it is a case that is fact- specific or involves a great deal of detail, such as an DWI case. When the client is first in the office, we have them fill out the Confidential New Municipal Court Interview Form. We obtain background information such as their name, address, the offenses charged, date of the persons arrest, other witnesses, statements given to them by the police, their occupation and information regarding prior motor vehicle convictions. Our interview sheet also asks if there is anything else important, such as a medical condition that affects their case. This form will also let us know whether or not the client will follow instructions and cooperate with us. After reviewing the summons and the interview sheet, I ask a series of questions of the client. We request the client wait until the end of the interview before explaining their side of the story. We also ask them if there is anything else of importance in connection with the case that we should know. 2. Retaining the Attorney Rule 1:11-2 of the Rules of Professional Conduct indicate a retainer letter or written statement of fees is required for new clients. I also provide all my clients with written information explaining how to appear in court, information on surcharges, information on points, and information regarding substance abuse treatment, if applicable. Once we receive our retainer (are paid), we begin work right away. Usually while the client is still in the office, we prepare a discovery letter on the computer to the prosecutor/district attorney and court and hand a copy to the client. We occasionally call the court to advise them that we will be handling the case and to inquire who handles discovery. We check the Lawyers Diary to determine who are the judges and prosecutor/district attorneys for the county or town. It is important to learn about the judge and the prosecutor. We require a great deal of cooperation from our clients in an effort to help keep their costs reasonable. We require our clients to take photographs of accident sites and prepare diagrams and provide us with the names, addresses, and telephone numbers of witnesses. I recommend that my clients provide me with a list of between 10 to 15 reasons why they should not go to jail and why court should impose the minimum license suspension. We recommend they obtain a Motor Vehicle Abstract. This provides us with information for mitigation of penalties and also provides information to be considered by the judge in sentencing. 3. Post Interview Work We also make a Motion to Suppress where there is a question regarding the validity of a stop or search. Any other Motions to Dismiss should be made in writing such as statue of limitations or lack of jurisdiction. Oftentimes in cases that deal with just one disputed issue such as the admissibility of a blood test result in alcohol or drugs, we can make a Motion in Limine or suggest a pre-trial conference. It is often a good idea to try to know how the judge will decide in order to save us a three-hour trial on a complicated case. If the court rules against us in the Motion in Limine we can enter a guilty plea contingent upon reserving your right to appeal on that one issue. 4. Discovery Phase Oftentimes we do not receive all of the discovery that we request. We send a letter to the prosecutor requesting additional discovery and request that the discovery be provided within 10 days. If we do not receive the discovery with 10 days then we prepare a Motion to Compel Discovery. In the case involving essential witnesses, we occasionally write to the witnesses and ask them to call us so that we can find out what really happened. If possible I have a law clerk call up after we send the initial letter. The attorney cannot testify if the witness provides an inconsistent statement but our law clerks can testify. I sometimes speak to friendly witnesses myself later to make a decision to determine whether or not the witnesses are credible. Upon receiving discovery, we forward a photocopy of all discovery to our client. We then discuss with the client whether or not they have a reasonable prospect of winning. In drunk driving cases we review the videotape with the client prior to the trial date and sometimes make arrangements to retain an expert. 5. Preparing for Court If it is a DWI blood case, we should make an objection to the entry of the lab certificate as evidence at trial. We are also under a responsibility to provide any reciprocal discovery to the prosecutor. Occasionally, in a court where there is only one prosecutor you should call the criminal court prosecutor ahead of time to see if a matter can be worked out or plea bargained. Some prosecutors in lower courts work part time and are not compensated for the many telephone calls they get in their offices. If we discover a favorable case, we make a copy for the judge, prosecutor, and client. Never assume the part time prosecutor or judge is familiar with all the laws. We can prepare a Subpoena ad Testficandum for witnesses to testify and Subpoena Duces Tecum for witnesses to bring documents. We have our clients hand deliver the Subpoenas and write out their own check for the subpoena fees. It is better to be over-prepared than under-prepared. Over the years I have made it a practice to build up files on particular legal subjects with complete case law. I now have files for drunk driving, driving while suspended, drugs in motor vehicle, and careless driving. When we receive the hearing notice we send a follow up reminder to the client to be on time, bring all papers and call 24 hours ahead to confirm the case is still on the calendar. The client should be prepared and look neat. The Grateful Dead and Budweiser T-Shirts should be replaced with something that looks presentable. They should have their pregnant wives sitting next to them. Preparation is the key to winning cases or convincing the prosecutor of exceptional defenses. Upon arrival at court, we will attempt to ascertain if the police officer is available. Sometimes the police officer is on vacation, retired, or suspended. This may assist your ability to work out a satisfactory arrangement. There is no prohibition against speaking with States witnesses in a non-threatening way. Outside of the courtroom, I usually call out the name of the non-law enforcement States witnesses to determine what their version of the facts are. If we have an excellent trial issue but believe the judge is going to rule against us, we bring an appeal notice and file it with the Court on the Record. I keep in my car blank forms for Order to Compel Discovery, Order Mark Try or Dismiss, Order to be Relieved, and an Appeal Notice. 6. Plea to a Lesser Defense If the client is going to enter a guilty plea to an offense, it is important they understand what the offense is and put a factual basis on the record. The Judge will be angry if a person is pleading guilty to a drunk driving case and the judge asked them what he had to drink, the person insists he only had one beer. The judge will send us back to our seat and must refuse to take the guilty plea unless an adequate factual basis is put on the record. Having previously obtained for my clients their favorable background, I usually put on the record reasons why the judge should give them the minimum penalties. Letters of reference and character reference letters are helpful in cases where the judge has wide discretion in his sentencing. After the client pleads guilty, it is a good idea to also ask the client on the record if he has any questions of myself or of the court. 7. Conclusion Whether or not we have a trial or there is a plea to reduce the charge, I wish to walk out knowing I did the best you could for the client. Even if I lose, I want to have been such an articulate advocate that the client walks out saying my attorney is great but the judge is wrong. We try to be innovative and prepare new arguments. Jason here, I wanted to share with you the whole story, not what was glazed over:
The $200,000 figure came from multiple loans and credit card bills over a period of time (I was not encumbered with this entire debt overnight).
After a variety of court procedures and legal agreements I was able to significantly reduce the amount of money I had to pay out of my own pocket. The total actually paid out of my own pocket was $65,000 for the entire debt.
I worked at several jobs, but the first step to fixing my problem was by obtaining a minimum wage job.
Since hourly work in the service sector can be spotty at best I often had to keep two or more jobs to maintain at least 30 hours worked per week. Some weeks I was able to pull in upwards of 60 hours, while other weeks I was only able to clock in 20.
