Assassinations, Spying and The Constitution: ACLU President Susan Herman Talks Big Govt and Liberty
"All of our elected representatives have to hear from a broad cross section of liberals, libertarians, conservatives--people who just say, 'This is too much big government. We want our government back,'" says American Civil Liberties Union President Susan Herman, author of the new book "Taking Liberties: The War on Terror and the Erosion of American Democracy." How much has the police state expanded since 9/11, and is there any way to stop it? Herman sat down with Reason.tv Editor-in-Chief Nick Gillespie to discuss the this and other questions surrounding the state of liberty in America. Herman notes that while there have been a few minor changes in policy, for the most part there's been a remarkable continuity between the Bush and Obama administrations in terms of their disregard for civil liberties. She makes the case that liberals must make alliances with libertarians and pro-liberty conservatives like Ron Paul and Gary Johnson if there's any hope of curbing the ever-expanding police state. She also discusses the recent assassination of American citizen Anwar Al-Awlaki and the ACLU's role in representing Al-Awlaki's father in court. Interview by Nick Gillespie. Edited by Zach Weissmueller. Approximately 17 minutes. Rehabilitating Lochner: Defending Individual Rights against Progressive Reform
[LESS INFO] 2 VIEWS | ADDED 20:00:00 05/02/11
(http://www.cato.org/store/books/rehabilitating-lochner-defending-individual-rights-against-progressive-reform)No Supreme Court decision concerning economic liberty has been more emblematic of the alleged errors of the "old," pre-New Deal Court than Lochner v. New York, decided in 1905. Upholding contractual freedom against a New York statute that limited the hours that bakers might work, the decision has been reviled by both liberals and conservatives as an egregious example of judicial malfeasance — cited today most often for the prescient dissent of the sainted Justice Oliver Wendell Holmes. Yet the story of Lochner is not over. In a new book that examines the history and background of the case, David Bernstein argues that the decision has been widely misunderstood and unfairly maligned, that it was well grounded in precedent, and that subsequent battles over segregation laws, sex discrimination, civil liberties, and more owe much to the limited-government ideas of Lochner's proponents. Please join us for what is bound to be a lively discussion about this important new book.

Social critic Wendy Kaminer draws paralles between conservative opposition to the he planned Park51 Muslim community center near Ground Zero and liberal attempts to limit "politically incorrect" speech. Kaminer points out that both arguments support curbing First Amendment rights in the interest of protecting a group from emotional harm.

The clearance by the New York City Landmarks Preservation Commission for the so-called "Ground Zero mosque" to be built in lower Manhattan received national coverage amidst a raging debate. Initiated by Sarah Palin and Newt Gingrich and then weighed in upon by Mayor Bloomberg and President Obama, the debate focuses on whether Park 51, the 13-story Islamic cultural center, should be allowed to be built so close to 9/11's Ground Zero.
Those who oppose Park 51 argue either that the project is insensitive because Ground Zero is unique and a kind of "hallowed ground," as journalist Charles Krauthammer put it, or that it is politically motivated by an anti-American agenda and should not be treated with the same tolerance as a religious institution. Those defending the Islamic center have been quick to label opponents as bigots and claimed the center will be a bridge to cultural harmony by promoting moderation, non-violence, and diversity.

American Taliban author and Daily Kos founder Markos Moulitsas states his position on the proposed Senate filibuster reform. Moulitsas advocates for the elimination of filibusters altogether, claiming they facilitate corporate manipulation of votes.

America's main international enemy -- Islamic radicalism -- favors theocracy, curtails civil liberties, embraces torture, represses women, reviles homosexuality, subverts science and education, and reveres force over diplomacy.
In American Taliban, Markos Moulitsas shows how the American right shares those very same traits. He argues that our domestic jihadists are a greater threat to American democracy than any Islamic terrorist. - The Booksmith
Markos Moulitsas is the founder and publisher of Daily Kos, America's largest online political community. His publications include the acclaimed Crashing the Gate: Netroots, Grassroots, and the Rise of People-Powered Politics and Taking on the System: Rules for Radical Change in a Digital Era.
He is a frequent guest on cable news and shows like "Meet the Press" and "Real Time with Bill Maher," a weekly columnist for The Hill, and a former Newsweek contributing columnist.
