This is the unedited bulk of a relatively long hearing on the application of Ridgefield's "Crown Carting" for the ability to establish a Waste Transfer Station in Ridgefield, NJ. ........The original application included "Type 10" waste which is the putrescible/stinky stuff (disposable diapers etc etc etc) we normal think of as household/hospital (yes the statute goes out of its way to include that category......talk about a massive petri dish!!!) garbage. ......... That application was totally withdrawn after local community activists turned on a few lights and the local Town Council and Mayor raised issues/objections.....but clearly the INTENT was there to simply slide this thing through the regulatory process in the dark....and if they could have gotten away with it that first proposal would have continued on its "merry" way.*******According to the local newspaper account there were about a hundred attendees......according to the observations of some of the people there, there were closer to two hundred. ...........In any case there were far more people than available seats and there were people standing all around the room and into the hallway entering the room and even standing outside into the foyer! As you can see and hear from the video....the presiding BCUA Commissioner was visibly surprised at the turnout......and keep in mind that this was scheduled right at 6:00 PM and on a hot summer day. The air conditioning didn't extend well into the hallway and some of the folks there couldn't all even hear what was going on. ******* As the hearing progressed there were a good number of people who had signed up to speak.......but weren't able to wait two hours and left early. ***********What you see here is raw footage of the hearing......... and kudos to all you policy wonks and very concerned residents who have the stamina/attention span to watch the whole thing! I suspect that many of the people who will be watching the whole thing will be people who will be being paid a GREAT DEAL OF MONEY to do so.....and that that category of individuals will likely be doing the bidding of the applicant, for whom this obviously represents a golden opportunity to make more money......and in all manner of potential scenarios! ***** Ideally, public policy decisions should be driven by what's objectively best for the people of the community as a whole.....and not what's best for the most wealthy, powerful, ambitious and ruthless minority. ******That's what democracy is all about; human rights, common human decency, fairness, justice, honesty and doing what's right because it's right.....not just doing what can make you more money at the expense of the potential health and well being of the broader community......democracy is also about the rights of the individual, and the applicant here deserves respect for asserting his own rights *within the framework of the law*. Let's face it, it's the job of a business to make money and the more money the better.....there are no limits, so long as folks stay within the law. *******The larger issue here is the extent to which the letter of the law is perverted by individuals who regulate and enforce the statutes in ways that violate the SPIRIT (if not the letter) of the law. ............Yes, recycling IS a good and necessary thing; but it's wrong to use recycling as a pretext to do something which will cause far far far greater harm to the community at large than the relatively minimal costs of having the marginal amount of recycling in question be done in another facility........I truly hope that I was 100% wrong in my closing remarks at this hearing wherein I stated that this would likely be a long and drawn out struggle....and that the governing bodies would only do the right thing if there was massive organized informed and focused public opposition........I want to be wrong! I would be elated to see the BCUA commissioners stand up and dismiss this flawed application at their earliest opportunity. This should NOT go to the next stage.....but if it does, it is clear on it's face that the ONLY way to stop it will be the application of sheer logic, facts, rationality, intelligence, common human decency/common sense AND a very healthy dose of community involvement/activism. Without that last ingredient our democracy is a hollow farce and we are left to live our our lives in a de facto plutocracy in which those with money to buy the laws and the lawmakers and the law enforcers "win". That's not a sustainable long term model for human existence.

This is the second part of a Ridgefield NJ town council meeting at which an expert, who was hired by the town, gave a report of his findings/views regarding the proposed "Waste" Transfer Station that is proposed for Ridgefield. *****The original application included household/hospital "putrescible" garbage/waste (Type 10) but when wind of the proposal reached a few Ridgefield residents and the Town's Mayor and council the reaction motivated the applicant to withdraw that application and resubmit one which would still include bulk waste (garbage) and construction waste (garbage)........the latter categories may not smell as bad but the potential repercussions and associated consequences are just as stinky in their totality. *********As you can hear from the expert's report, he rightly believes that the application that he reviewed (AS IT WAS SUBMITTED) was/is fatally flawed in that it was utterly incomplete and without objective merit. *********The first part of the session was taken up by the discussion and vote on the question of supplying a bus for Ridgefield residents who might wish to attend the BCUA hearing to inform themselves and to comment pro or con. This second part includes some comments from the attending public on various issues. ********Here you can hear some of the interesting discussion on the question of whether the town should supply some transportation for folks to attend the BCUA hearing.....I believe they voted correctly to enable that since anyone pro or con could get on the bus to come to be informed and to speak out either way. After a good discussion the motion was passed.............and the attendance at the BCUA meeting was far in excess of the "100" claimed by the local newspaper....closer to two hundred!!! "Nj Governor Jon Corzine Sued For Genocide !"

Brian Thompson of WNBC TV News is interviewing Chairman Ron Yonaguska Holloway just after the filing of a federal lawsuit.What follows is a statement issue by from a source close to the plaintiffs....NJ Governor Jon Corzine and Secretary of State, Nina Wells sued for Genocide and Crimes against Humanity!On March 3, 2009, federal court summonses were served on New Jersey State Governor Jon Corzine; NJ Secretary of State, Nina Wells; and The Native American Commission of NJ, naming them defendants in a 13 count Law Suit filed in Newark Federal Court, Newark, NJ, on February 17, 2009, for but not limited to: Genocide and Crimes against humanity; Violation of the Ku Klux Klan Act of 1871, water rights; as well as treaty violations. This suit was filed by the New Jersey Sand Hill Band of Lenape & Cherokee Indians. The law suit was the result of a 10 year effort on the part of the Federally recognized Sand Hill Band of Lenape & Cherokee Indians; and the Ani-Tsalagi Onaselagi Northeastern Band (Cherokee) to address legal inequities, including but not limited to: Sand Hill treaty violations, the illegal sale of Sand Hill lands (resulting in the first acts of genocide), representation on the Indian Commission, as well as correcting a report written by a NJ State Committee established by the Governor. The purpose of this report was to address the problems confronting all Native Americans in the State of NJ. Two sitting Indian Commissioners were appointed to Committee. The end result of this report committed historical genocide by removing the histories of the Cherokee & the Lenape - Cherokee Indians, and stating that only the Lenape were indigenous to NJ. This action permitted the three Lenape groups, the Nanticoke (from MD/PA 1975), the Powhatan (from VA 1975), and the Ramapough Indians, to claim that they were the Native Americans indigenous to the state and incorporating the Cherokee and the Lenape - Cherokee history into their history in a way that would effectively remove two established tribes from NJ history. These Tribes are: The Federally recognized NJ Sand Hill Band of Lenape & Cherokee Indians; and the Ani Tsalagi Onaselagi Northeastern Band (Cherokee).The above mentioned Indian entities (Nanticoke, Powhatan and Ramapough) are 501-3c non profit organizations, not recognized by the Federal Government or by the State of NJ as Indian Tribes. Two of them having arrived in 1975.This report is an alleged blatant attempt by the State of New Jersey, in conjunction with the Commission, to eradicate the existence of two tribes, one of whom is indigenous to the State (The Sand Hills) and the other (Ani Tsalagi) whose ancestors arrived in 1830 (including descendants from the four migrations of Cherokee into NJ), as well as a large number of Native Americans living in the state, by permitting only the Lenape Native American 5013cs to be included in the report as having any history.Both the Governor and Secretary of State were informed that this report was an act of Genocide by the leadership of both the Sand Hill Band of Lenape & Cherokee Indians and the Ani Tsalagi Onaselagi Northeastern Band (Cherokee) many times through letters, meetings, etc. They had been warned that if the report was not corrected, then the two Tribes would be forced to take legal action. Neither the Governor nor the Secretary of State of New Jersey did anything to correct the historical inaccuracies written into the report. In October, 2008, Gov. Jon Corzine signed an executive order accepting the report as written, allegedly committing historical genocide by removing the histories of the two Indian tribes. Due to previous contact with the Governor and Secretary of State regarding these legal inequities, it is alleged within the suit that the Governor and Secretary of State are guilty of conspiracy to commit genocide.These videos are press interviews with Chairman Yonaguska Holloway of the Sand Hill Band of Lenape & Cherokee Indians that took place on February 17, 2009, immediately after filing the Law Suit in Federal Court against the Governor, Secretary of State, 21 NJ Counties, all Freeholders, and the American Indian Commission.The Comptroller of NJ was also served a summons on March 3, 2009, as he must set aside the one trillion dollar amount mentioned in the suit until the suit is settled. The Attorney General of NJ was issued a summons as well.Because of this suit, Federal funds that would have helped NJ's taxpayers will now probably be spent in hiring lawyers to defend the 21 Counties and the defendants mentioned because the State refused to recognize the legitimacy of the Sand Hill Band of Lenape & Cherokee Indians and the Ani Tsalagi Onaselagi Northeastern Band claims, as well as to rectify a historically incorrect report. Had the State of NJ investigated the concerns of the leadership of the two Tribes, it would have discovered that the NJ Sand Hill Band of Lenape & Cherokee Indians and the Ani Tsalagi Onaselagi Northeastern Band should have been given seats on the Commission, as well as recognition by the State. Had those two actions occurred, this law suit probably would never have happened. Any and all concerns would have been addressed and settled behind the scenes through negotiations as is the Traditional Indian way. Not out in the public arena.For whatever the reason, neither the Governor nor the Secretary of State understood, or for whatever the reason, were unwilling to understand that they were dealing with well versed, educated, and very traditional Tribes. Unlike the 5013Cs they have been dealing with since 1998. The Sand Hills have repeatedly attempted to correct this situation over the years but have met with no significant success and, in my opinion have been disrespected by the "powers that be".Finally, last summer, the Sand Hill Band of Indians went public with some limited blogging that began to light a tiny candle in the massive dark shadow of ignorance that is the average citizen's level of knowlege regarding American Indian affairs/history in general. I read the blogs, began to become more fully informed, and engaged in blogging/sharing my own perspectives. Frankly, what I saw happening here in NJ was/is a kind of cultural genocide. To deny a people their heritage and their identity is a strike at the core of what it means to be a human being. I was/am disgusted and outraged by the sheer incorrigible obstinacy that the State of New Jersey has displayed regarding the provision the simple recognition and respect due to these good and proud people.....who, frankly, had been extremely reluctant to "go public" with these problems; and have only done so as a last resort. In this "Commission", we have an official organ of the State government that operated under the aegis of the New Jersey Secretary of State.....which is actively denying the existence of the Sand Hill Band of Indians as an indigenous tribe to New Jersey.....and that's just dead wrong. I became more involved to the point of attending and recording the September and November meetings of the Commission. Evidently, the few sparks of publicity that resulted from the blogging was sufficient to motivate the Commission to, at least, allow the Sand Hills to make a presentation at the September meeting. An understanding was reached that at the September meeting Ronald Yonaguska Hollaway would be allowed to speak at some length. That understanding was violated, and he was forced to curtail his remarks. A video of that process/fiasco was put up on the web along with the 9 or so minutes that Yonaguska was actually allowed to speak. The irony is that they (the commisioners and their legal council) wasted 13 minutes in a procedural kerfuffle designed to merely give Yonaguska the same 5 minutes that anyone else would get....and then, finally/grudgingly, allowing him ten minutes. Ironically about 23 minutes were consumed......when all the Sand Hills were asking for was 20 to start with. Perhaps the fiasco in September and the attendant publicity had some motivating effects, since Yonaguska was able to come to the November meeting and was given sufficient time to make a cursory case. Something very special and amazing just happened!A bill that was on a greased path to passage just failed!New Jersey's senate (at leat 21 of them) chose to go"off script" and to vote down a terrible bill that defied all logic and comon sense.The "fix" was in.....but people actually chose to vote their common sense against the pressure applied by the "leadership".This is indeed extraordinary and gives one hope for the future!

This is video of Holt's testimony before the NJ State Senate Goevrnment Committee yesterday (Thursday 12/11/08). (The first few minutes of his remarks is missing; but as you'll see....he makes his case quite clear in the testimony that is present. This law was passed in 2005 and its implementation has already been delayed once. There is also a provision which allows he state to "test" reworked touch screen machines (with technology from the 70,s and 80's) with external printers. Then twice in 2008, the Legislature extended that deadline, first to June 2008, then to January 2009.Now verifiable voting in New Jersey will be delayed indefinitely unless you act. Stephanie Harris Coalition from Peace Action, Irene Goldman Coalition from Peace Action, Marcia Marley and Ann Rea from BlueWaveNJ, Mike Shapiro of the NJ Tenants Union and Nick Lento are all speaking in opposition to the passage of A3458.Back in 2005 the NJ legislature (in response to a lawsuit initiated by NJ voter Stephanie Harris) passed a LAW stating that NJ would have secure voting machines that provided a voter verifiable paper trail.After years of foot dragging and delays they finally postponed implementation of the law to January of 2009.Now on November 13th they post a law that postpones the deadline to November of 2010!!! The scene in the video takes place on Monday December 8th at a committee hearing whose "job" it is to ram this through so the Senate can do the same on Thursday and a full vote would likely pass it just before years end and then Governor Corzine would sign this into law along, no doubt, with a stack of other bills requiring passage before year's end.There will be no signing ceremony for this one. They had to sneak it in at the end of the year so that the state of New Jersey wouldn't be in violation of its own law! I guess when you make the laws it's ok to simply change them when compliance becomes inconvenient.
